Terms and conditions

This English translation is provided for your convenience. The Dutch version is legally binding.

Article 1 — Definitions

In these Terms and conditions, the following terms mean:

fixtek: The private limited company Fixtek B.V., established in Veenendaal, registered with the KVK (Dutch Chamber of Commerce) under number 99820439, VAT number NL869146920B01.

Customer: Any legal entity or natural person acting in the course of a profession or business that enters into an agreement with fixtek.

Products: All fastening materials and accessories offered by fixtek.

Article 2 — Applicability

2.1 These terms apply to all offers, orders and agreements between fixtek and the Customer.

2.2 fixtek supplies only to business customers (B2B). Orders from private individuals are not accepted.

2.3 The statutory right of withdrawal (14-day cooling-off period) does not apply to business transactions.

2.4 Deviations from these terms are valid only if agreed in writing.

Article 3 — Prices

3.1 All prices are in euros and exclusive of VAT, unless stated otherwise.

3.2 Prices are based on the rates applicable at that time and may be changed without prior notice.

3.3 Volume discounts are calculated automatically on the basis of the customer level.

Article 4 — Order and agreement

4.1 An agreement is formed at the moment fixtek confirms an order in writing or electronically.

4.2 fixtek reserves the right to refuse orders without giving a reason.

Article 5 — Delivery

5.1 fixtek aims to deliver orders placed before 12:00 on the next working day.

5.2 Stated delivery times are indicative and never constitute a strict deadline.

5.3 Delivery takes place at the delivery address specified by the Customer.

Article 6 — Payment

6.1 Payment must be made within 14 days of the invoice date, unless agreed otherwise in writing.

6.2 If payment is not made on time, the Customer is in default by operation of law and fixtek is entitled to charge statutory commercial interest.

Article 7 — Returns

7.1 fixtek supplies only to business customers. The statutory right of withdrawal does not apply to B2B transactions.

7.2 Returns are possible only as a goodwill gesture, after prior written approval by fixtek, and within 7 working days of delivery.

7.3 Products must be unused, undamaged and in the original unopened packaging.

7.4 Returns must be notified in advance via info@fixtek.nl.

7.5 The costs of return shipment are borne by the Customer. For approved returns, a handling fee of 15% may be charged.

7.6 fixtek reserves the right to refuse returns.

Article 8 — Warranty

8.1 The manufacturer's warranty conditions apply to all Fischer products.

8.2 fixtek acts as intermediary in warranty matters between the Customer and the manufacturer.

8.3 Defective or damaged products must be reported immediately upon receipt. In the case of errors on the part of fixtek, we arrange replacement or credit free of charge.

Article 9 — Liability

9.1 The liability of fixtek is limited to the invoice amount of the order concerned.

9.2 fixtek is not liable for indirect damage, consequential damage or loss of profit.

Article 10 — Governing law

10.1 Dutch law applies to all agreements.

10.2 Disputes are submitted to the competent court in Midden-Nederland.
